  • Account means a unique account created for You to access our Service or parts of our Service.

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Application means the software program provided by the Company downloaded by You on any electronic device, named Sing Sharp

  • Content refers to Your content generated or created through or upload to the Services, including but not limited to recording, progress data, vocal data, pitch data, performance data, and textual content.

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Harmony Network Group Limited, registered under the law of Hong Kong .

  • Country refers to: Hong Kong SAR

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service refers to the Application.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

Collecting and Using Your Personal Data and Content

Personal Data and Content

You have an option to use Our Service without creating a personal account by “Guest Login”. If You choose “Guest Login", no personal identifiable information will be collected. However, this option also run the risk of losing all Your data and progress once You delete the Application on Your device, or if an error occur.

In order to enhance your experience by providing you with seamless access to Our Service on Your multiple Devices, also to persistent your content and prevent data loss due to error or other reason, We provide the option for You to create Your personal account. We do so by identifying you and making Your Content available on Your multiple Devices.

If You choose to create Your account while using Our Service, we may ask You to provide us with certain personally identifiable information that can be used to identify You. Personally identifiable information may include, but is not limited to email address, name, and/or Usage Data.

If You use Facebook, Google, or Twitter to register for or log in to the Services (or later connect Your accounts), You authorize Facebook, Google, or Twitter, as the case may be, to share Your personal information with us, including Your email address, profile photo, and publicly available information about You.

Similarly, if You access the Services with another third party social network we may collect information that You have agreed to make available, such as Your name, user ID/URL, profile picture, email address, etc.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with.

If You send us support requests, comments, or email, You may also provide us with additional information to enable us to contact You and address Your feedback and we may retain such information to enhance our Services and to respond to You.

Your Content and data is generated or created when using the Services, including but not limited to recording, score, performance, pitch accuracy, vocal range, and other vocal characteristics. Your Content will be collected and processed in order to provide Our Services, such as providing personalised vocal training based on Your vocal characteristics data.

When You purchase a subscription or other items offered via the Services, all In-App Payments are processed by Apple Store and/or Google Play, We don’t collect any payment information by Ourselves.

In addition, We don’t ask You to provide us with any sensitive personal information, such as information relating to Your race or ethnic origin, political opinions, religious or philosophical beliefs, membership of a trade union, physical or mental health, genetic or biometric information, sexual life or sexual orientation, etc.

Usage Data

Usage Data is collected automatically when using the Service.

​

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We receive device identifiers like Apple’s IDFA, IDFV and Google’s AdID. These are principally used for online advertising and marketing purposes.

Our advertising partners, such as Google Admob, may use cookies and similar technologies to identify and deliver content and advertising specific to your interests, to track the effectiveness of such advertising and to provide and analyze their services.

We work with Google Analytics which collects Usage Data and information such as how often users visit our Service or website, what pages they visit when they do so, and what other sites they used prior to coming to the website. Google Analytics use cookies and/or identifiers for mobile devices (e.g., Android Advertising Identifier or Advertising Identifier for iOS) or similar technology that are used to collect data. You may opt-out of Google Analytics tracking with the Google Analytics opt-out browser add-on. We will not, and will not assist or permit any third party to, pass information to Google that Google could use or recognize as personally identifiable information. Use of Your Personal Data and Content

The Company may use Personal Data and Content for the following purposes:
 

  • To provide and maintain our Service, including to monitor the usage of our Service.

    Some processing is necessary because it is in Our or a third party’s legitimate interests in providing Services. Sing Sharp is designed to help You practice and improve your vocal techniques. The heart of the Service is to provide personalized vocal exercises by analyzing Your vocal characteristics. Content actively or passively generated during the use of the Service, including but not limited to recording, score, performance, pitch accuracy, and other vocal characteristics, may be collected and processed in order to provide the Services, including any personalized Services. We do so as it is necessary in providing an innovative and tailored offering to Our users.

     

  • To improve our Service: for the purpose of improving Our Services, We collect and study data or Content created actively or passively (such as optimising training courses by analyzing users’ progress and performance). We work hard to develop, enhance and improve Our Services (such as by providing better training courses). We may share de-identified data and Content with researchers to contribute to academic research. Where We contribute to academic research, we take into account Your rights and ensure that protections are in place with respect to Your information.
     

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
     

  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
     

  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

    We may use your information for customer relationship management (CRM) purposes, including for targeting email and other engagement campaigns

     

  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
     

  • To manage Your requests: To attend and manage Your requests to Us.
     

  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
     

  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.

  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.
     

  • With advertisers: We may share information about you or your use of the Services with our advertisers and third party advertising partners. This means that, in accordance with our legitimate interests, we may give our advertisers information about the characteristics of our users, along with sharing certain identifiers and/or location information, but we do not specifically identify you by name or share your contact information. Third parties can use this data to deliver targeted advertisements that they believe will be of most interest to you, in order to enhance your experience on our Service, or to assess the effectiveness and reach of advertising campaigns.
     

  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.
     

Retention of Your Personal Data and Content

 

The Company will retain Your Personal Data and Content only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data and Content to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data and Content for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Your information, including Personal Data and Content, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. Business Transactions

OPT-OUT AND DELETE YOUR PERSONAL DATA AND CONTENT

 

You can stop all collection of information by uninstalling the Service: You can easily stop collecting information from the Service by uninstalling the Service. You can use standard uninstalling processes that can be offered as part of your mobile device. Or you can change the Service’s access right at any time - from “Settings” on your Device.

Although uninstalling the Service immediately stop data collection and processing. But it does not delete the data already collected in Your account. You may log into your account at a later time to retrieve the data and Content.

In order to provide You with greater control over Your Personal Data and Content, “Delete Account” is available within the Service (Profile/Delete Account). It is true account deletion, all Your Personal Data and Content are permanently deleted from your Devices and from Our server. You will not be able to access or retrieve any data from deleted account. You are recommended to consider other options to protect your Personal Data and Content before considering account deletion.

Security of Your Personal Data

 

We maintain technical and organizational measures to protect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to your information. We endeavor to ensure a level of security appropriate to the risks that are presented by the processing, having all due regard to the state of the art, the costs of implementation and the nature, scope, context and purposes of the processing as well as the risk to users. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security.

If you cannot do this, or you do not have a Sing Sharp account, contact support via our https://www.singsharp.com/contactus. We may retain certain information as required by applicable law.

Object

If we process your information based on our legitimate interests explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. If you live in the European Economic Area, you also have a general right to object to the use of your information for direct marketing purposes.

Revoke consent

 

Where you have previously provided your consent, you have the right to withdraw your consent to the processing of your information at any time. For example, You can also revoke any consent You have provided to Our use of Your tracking permission or microphone access by changing the setting on your mobile device. If you withdraw your consent to the use of your information for purposes set out in this Policy, you may not have access to all (or any) of our Services and we might not be able to provide you all (or any) of the Services. In certain cases, we may continue to process your information after you have withdrawn consent if we have a legal basis to do so or if your withdrawal of consent was limited to certain processing activities.
